The Criminal Law Consolidation (Stalking and Harassment) Amendment Act 2025 strengthens and updates South Australia’s stalking laws, so that they are easier to prove and better cover modern cyber-stalking behaviours.
Implementation progress update
The Criminal Law Consolidation (Stalking and Harassment) Amendment Act 2025 was passed on 4 February 2025 and commenced on 8 June 2025. The Act renames the existing offence of 'unlawful stalking' to 'stalking and harassment' and expands the offence to cover a broader range of stalking conduct, and to ensure that new methods of cyberstalking are adequately reflected. The reform also introduced an objective mental element as an alternative to proving the defendant intended to cause the victim harm or serious apprehension or fear.
